After the commercial activities developed in our country and all over the world, the Code of Obligations, which is a part of the Civil Code, has started to fall short. In this process, Commercial Law emerged as a special field. This branch of law requires special expertise. It includes more comprehensive debts, liabilities of companies, technical accounts and concepts.

It is the branch that covers commercial transaction laws between two parties. The rights of traders are guaranteed by law. This way, business owners and buyers mutually know what rights they have and can easily know what steps to take. This branch of law covers all legislation and rules related to trade. In addition, the Capital Markets Law, Bank Cards and Credit Cards Law are also covered by the Commercial Code.

The law on commerce sets out the relationships between individuals and companies. Here, the definitions of concepts such as merchant, commercial enterprise, trade registry, trade name, unfair competition, commercial books, current account, agency and partnership are made clearly.

What is the Scope of Commercial Law?

The Commercial Law, which partially reveals the Code of Obligations and ensures that the empty fields are filled, also determines the scope of every issue that concerns a commercial enterprise. It has a wide scope for the structure of commercial firms, establishments, forms of organization, working activities, valuable documents, scopes related to private insurance and Maritime Law. In other words, we can express the scope of this type of law as follows;

Commercial Business Law: This is the branch of law that determines the scope of businesses within the scope of commercial law. It contains all the details such as the structure of the enterprises, the way they were established, and their liquidation. In addition, by revealing the differences between merchants and tradesmen, concepts such as commercial judgment, unfair competition, current account deficit are revealed.

Negotiable Documents Law:  Negotiable documents; A check is a document that has a value like a promissory note and reveals a right. The rights arising in these documents cannot be transferred to others. It is the scope that determines and resolves the situations, scopes and disputes about negotiable instruments.

Partnership Law: It is the branch of Commercial Law that determines the scope, conditions and the rules of disputes in all details of partnerships made under the titles of Collective, Limited, Joint Stock and Limited.
